Sales and marketing terminology | Tips about Business

Terminology / Acronyms
ABC figures: This is the independently audited sales figure for all recognised publications in the UK. By using the ABC figure, you can quickly establish how much the advertising will cost per 1,000 readers.

Account Managers: These are sales people who have great skills in getting repeat orders and maximising revenue returns from existing accounts. It is very rare that a good ?Account Manager? will be good at winning new clients.

Blue Bird: This is an unexpected sales opportunity that has a high chance of turning into profitable business.

BRAD: This book lists every UK publication including magazines, newspapers, vertical publications etc. It also contains key information i.e. ?ABC figures?, advertising deadlines etc and is one of the most useful tools available if you are looking to place advertising or embark on DIY PR.

Comfort Factor Statements: Also known as credibility statements they show that you can deliver exactly what you say you can. They must not be emotive i.e. include words like ?the best?, ?fantastic?, ?amazing?, ?superior? or contain anything that cannot be proven i.e. ?high level of customer satisfaction?, ?unparalleled support?, unless supported by facts.

Commission Plans: This is how a salesperson is paid for their efforts. It is strongly advised that you include a minimum contribution and ensure that if you plotted a graph of gross margin and percentage of target it would create an incremental curve.

CRM: ?Customer Relationship Management? This is software that organises all your sales contacts, schedules activities and is used in targeted marketing campaigns. This is vital to all sales operations and there are many packages to choose from costing anything from ?80.00 per user upwards i.e. ACT! Goldmine etc. Previously known as TCM.

Double Bubble: Sales slang for two people being paid out the full amount of commission on a specific deal / incentive or the same person being awarded double the amount of commission.

Elevator Pitch: This term comes from the theory that if you are in a lift on the 10 th floor of a building you should be able to explain what you do before it gets to the ground floor i.e. about 10 seconds. This is often the opening statement of any form of communication and is predominantly used in lead generation and marketing activities.

Farmers: These are sales people who have great skills in getting repeat orders and maximising revenue streams from existing accounts. It is very rare that a good ?Farmer? will be good at winning new clients.

Gross Margin: The difference between your buy price and your sell price.

Hunters: These are sales people who are very good at winning new accounts and getting the first order but tend to lose interest when they know that the new customer will continue to buy, this often makes them very bad farmers. Also known as New Business Sales Exec?s.

Kick Back: This is when a company gets an extra soft margin when they buy sufficient numbers / value of a product. i.e. if you buy 10 cars we will give you / or the company free servicing.

Minimum Contribution: This is the account value that all sales staff are required to reach, in gross margin terms, before any commission. This is put in place to ensure that commission is not paid before staff have covered their basic salary plus all other costs i.e. NI, travel, phone, expenses etc.

New Business Sales Exec?s: These are sales people who are very good at winning new accounts and getting the first order but tend to lose interest when they know that the new customer will continue to buy, this often makes them very bad farmers. Also known as ?Hunters?.

OTE: ?On Target Earnings? This is how much the sales person will earn if they hit their sales target. Please note that when the person has achieved 50% of target they should not earn more than 30% of their OTE. By using this method it creates a further incentive for the salesperson to hit the their sales target.

Over Ride: This is the term used when a sales person over achieves his target and hence is given a large bonus. Remember the bigger the ?over rider?, the bigger the incentive and hence this increases the motivation to over achieve the gross margin sales target.

PPC: ?Pay Per Click? This is a much-targeted method of advertising and enables sponsored links to be placed at the top of search engine results when your particular key words or phrases are encountered. For each sponsored link placed you are charged from as little as 10 pence upwards.

Prospect: A company / person that you know will require your services and they are looking to purchase. Particularly if you have been asked to bid for the work

RTR: ?Ready to Run? This is the term used mainly by advertising agencies or company?s for an advert which is ready to be placed. It is then common practice to place the advert on the deadline in order to get the lowest possible price.

Sales Forecast: The system that sales people and managers use to look at how much business is likely to be won each month, unfortunately these are often misleading due to sales processes that minimise inaccuracies not being implemented.

Sand Bagging: This is a tactic used by sales people who hold back orders so that as many as possible fall in the same month or quarter and hence they over achieve the target to win a large Over Rider. This is not only expensive because extra commission is paid but can also have very negative effects on cash flow. By having a properly implemented Sales Forecast it is very easy to establish if this is occurring.

SEO: ?Search Engine Optimisation? This is the method of making sure that your website gets lots of traffic and enables your company to be listed higher in the search engines for specific key words and phrases i.e. car hire Newcastle, buy discount fishing rods, mortgage advice etc. The downside of this methodology is that it takes several months for your website to get a good position on the major search engines i.e. Google, Yahoo etc.

Soft Margin: This is most commonly found in the reseller market and generally provided by the manufacturer in form of marketing assistance i.e. for every ?10,000 of product x sold we will provide you with y amount of money that must be spent on promoting our product / service.

Suspect: A company / person that you know will require your services but nothing else is known.

TCM: ?Time Contact Management? This is software that organises all your sales contacts, schedules activities and is used in targeted marketing campaigns. This is vital to all sales operations and there are many packages to choose from costing anything from ?80.00 per user upwards i.e. ACT, Goldmine etc. Now known as CRM.

TMUP: ?Target Market User Profile? this is the type of company / person that would be a prime target for your business i.e. single male 30 ? 40 and divorced or SME services based companies with staff of between 3-10 people based within 5 miles of central London etc. Finding and Targeting your prime TMUP will reduce the cost of sales and increase marketing and new business efficiency?s.

Tyre Kicker: This is a company / person who pretends to be interested in your product / service. This term comes from the motor trade when customers would kick the tyres to fain interest when they had no intention of buying a car and were just browsing / looking for a test drive. Sales people who are not performing and wish to give the impression that their sales pipeline is strong often put this type of prospect on their sales forecast.

USP?s: Unique Selling Points i.e. what makes your company different from its competitors. This is used predominantly in lead generation and marketing activities and therefore is a MUST HAVE for any sales strategy to work.

Steven Tyler buys fastest street-legal car

Hennessey Performance

The Hennessey Venom GT Spyder, custom-built as a convertible for rocker Steven Tyler.

By Courtney Garcia

Steven Tyler clearly prefers life in the fast lane. The ?American Idol? judge and Aerosmith frontman added to his rewarding year by buying the world?s fastest street-legal?car, a $1.1 million hand-built convertible known as The Hennessey Venom GT Spyder.

One of only five 2013 models to be?made, Tyler?s is the sole convertible of the batch, and is able to accelerate to 200 mph in 15.9 seconds. The musician came to the car?s makers with specific drop-top and motor requests, and accordingly, the car was custom-made based on the standard Venom GT prototype.

?We had to make a few structural changes to our integrated rollcage in order to be able to fit the removable top,? John Hennessey, the car?s creator and owner?of Hennessey Performance Engineering,?told Yahoo! Autos.?This increased the weight of our vehicle by about 30 pounds to a curb weight of 2743 pounds (1244 kilograms). We decided to increase the Venom GT's power to 1244 bhp to maintain our 1 horsepower per 1 kilogram power to weight ratio."

Tyler?s sleek and angled two-door black roadster can accelerate faster than any other vehicle, maxing out at 275 mph and beating Bugatti?s Veyron by 8 mph.

Basic versions cost $950,000, but the rock star?s rendition crossed the million dollar mark due to his removable hardtop roof. Additionally, the car had to be reformed to meet his request for a 7.0-liter, twin-turbo V8 engine.

Tyler?s new toy adds to a prosperous year for the musician. He?just completed his duties serving as judge on the eleventh season of ?American Idol,? and now prepares to go on the road with Aerosmith for their summer ?Global Warming Tour.?

The tour kicks off in Minneapolis on June 16.

Ion-based electronic chip to control muscles: Entirely new circuit technology based on ions and molecules

ScienceDaily (May 29, 2012) ? Klas Tybrandt, doctoral student in organic electronics at Linkoping University, Sweden, has developed an integrated chemical chip.

The results have just been published in the journal Nature Communications.

The Organic Electronics research group at Link?ping University previously developed ion transistors for transport of both positive and negative ions, as well as biomolecules. Tybrandt has now succeeded in combining both transistor types into complementary circuits, in a similar way to traditional silicon-based electronics.

An advantage of chemical circuits is that the charge carrier consists of chemical substances with various functions. This means that we now have new opportunities to control and regulate the signal paths of cells in the human body.

"We can, for example, send out signals to muscle synapses where the signalling system may not work for some reason. We know our chip works with common signalling substances, for example acetylcholine," says Magnus Berggren, Professor of Organic Electronics and leader of the research group.

The development of ion transistors, which can control and transport ions and charged biomolecules, was begun three years ago by Tybrandt and Berggren, respectively a doctoral student and professor in Organic Electronics at the Department of Science and Technology at Link?ping University. The transistors were then used by researchers at Karolinska Institutet to control the delivery of the signalling substance acetylcholine to individual cells. The results were published in the Proceedings of the National Academy of Sciences.

In conjunction with Robert Forchheimer, Professor of Information Coding at LiU, Tybrandt has now taken the next step by developing chemical chips that also contain logic gates, such as NAND gates that allow for the construction of all logical functions.

His breakthrough creates the basis for an entirely new circuit technology based on ions and molecules instead of electrons and holes.

USC Dornsife Scientific Diving: Diving into Apra Harbor s Western Shoals and CB Junkyard

By Santiago Fernandez-Barrera

Drenched by the torrential rains of Guam as a tropical depression petered out to the northwest, my classmates and I loaded up the dive boat with gear as we prepared for our first set of dives since leaving Catalina Island. Suddenly, the clouds cleared and we set off through the mangrove forests into Apra Harbor.

Our destinations for the day were Western Shoals Reef and SeaBee Junkyard, where we would be making our first coral reef dive and practicing our data collection methods for use on Palau. Out in the distance, on the south side of the harbor, I could see the naval base that is one of the principal uses of Apra Harbor. Although it already covers a large area, I had to remind myself that the military footprint on Apra Harbor might increase still more if the proposed carrier berthing goes through.

Pulling myself back into the task at hand I prepared for our dive at Western Shoals. After a dive briefing by USC Dornsife Dive Safety Officer Gerry Smith, we put on an unusually light amount of gear, looked out at the horizon and stepped off the swim step, unprepared for the sight that awaited us.

Unusually free without the clumsiness of a 7-mm wetsuit, I descending onto the reef below. Thousands of coral heads fanned out forming tiny skyscrapers for multicolored fish to swim between.

I followed my dive buddy and professor, Dave Ginsburg, deeper along the reef to take a closer look at the marine environment below. Covering a majority of the reef, Porites coral takes on several forms, creating a multilayered landscape speckled with brightly colored fish, sponges and soft corals.

After a few meters Dave turned to me and pointed at his ears and then at a peculiar blue mantle emerging from the coral. I immediately recognized that he was pointing at a massive elephant ear sponge, a species found in Guam only in Apra Harbor. As I considered the sponge I realized that dredging a nearby reef for the proposed carrier berthing would very likely cover this area with sediment and threaten not only sponges but other reef species as well.

Swimming forward, Dave began to wave his fingers out in front of him at a school of butterfly fish. Puzzled I followed suit and was amazed to see them school around us, curiously inspecting our fingers. My classmates soon caught on and before we knew it we were surrounded by dozens of other curious little fish.

Still mesmerized by the sight below I slowly ascended, readying myself for the next dive. Above water we were reminded that this area hosts an active military site by a passing nuclear submarine being escorted back to the naval base. We headed to SeaBee Junkyard to do our first transact tape survey in Micronesia.

Located next the Glass Breakwater, SeaBee Junkyard is characterized by an assortment of discarded WW II relics that are sometimes overgrown with marine life. Due to its shallow depth and sandy bottom, this was the chosen location to practice our data collection techniques. Tying off our transect tape to a bulldozer dropped here 67 years ago, my group and I headed out at 330 degrees to begin our survey of the area.

Surveying both fish and invertebrates we were able to identify the indicator species that we had so diligently memorized prior to our arrival in Guam. Having finished our survey and rolling up our transact tape we were free to swim around and inspect the junk dropped by the military so long ago.

I was able to collect a little souvenir, a 1945 Coca Cola bottle. Exhausted after a long day of diving we readied ourselves for the next part of our journey through Micronesia. Apra Harbor was just a taste of what?s to come and a firm reminder of the importance of our work in the field.

The Consumer: Waking Up to Major Colonoscopy Bills

Patients who undergo colonoscopy usually receive anesthesia of some sort in order to ?sleep? through the procedure. But as one Long Island couple discovered recently, it can be a very expensive nap.

Both husband and wife selected gastroenterologists who participated in their insurance plan to perform their cancer screenings. But in both cases, the gastroenterologists chose full anesthesia with Propofol, a powerful drug that must be administered by an anesthesiologist, instead of moderate, or ?conscious,? sedation that often gastroenterologists can administer themselves.

And in both cases, the gastroenterologists were assisted in the procedure by anesthesiologists who were not covered by the couple?s insurance. They billed the couple?s insurance at rates far higher than any plan would reimburse ? two to four times as high, experts say.

Now the couple, Lawrence LaRose and Susan LaMontagne, of Sag Harbor, N.Y., are fending off lawyers and a debt collection agency, and facing thousands of dollars in unresolved charges. All this for a cancer screening test that public health officials say every American should have by age 50, and repeat every 10 years, to save lives ? and money.

?Doctors adopt practices that cost more, insurers pay less, and patients get stuck with a tab that in many cases is inflated and arbitrary,? said Ms. LaMontagne, whose communications firm, Public Interest Media Group, is focused on health care. ?I work on health care access issues every day, so if I?m having a hard time sorting this out, what does that say for other consumers???

More than 20 million outpatient endoscopy procedures are performed in the United States each year, and the number is growing. A few hardy patients decide that they do not need anesthesia at all. Most receive conscious sedation, a combination of drugs that block pain and help patients relax while remaining conscious; three gastroenterology societies recommend this option as adequate in cases where there are no complications.

Still, a growing number of patients appear to be receiving full anesthesia. Some gastroenterologists say that patients recover more easily after full anesthesia and that the exam is better. But there is no clear scientific evidence to support this, and critics say that an extra pair of hands in the room simply allows the doctor to perform more procedures.

According to a study by the RAND Corporation, published this year in The Journal of the American Medical Association, use of anesthesia administered by an anesthesiologist or nurse anesthetist during outpatient gastroenterology procedures, mostly colonoscopies, has more than doubled in recent years, to more than 30 percent in 2009 from 14 percent in 2003. Most of the increase occurred among low-risk patients who could do without the expensive service. But the practice varies from region to region: Only 13 percent of gastrointestinal procedures in the West involved an anesthesiologist or nurse anesthetist, compared with 59 percent in the Northeast, the study found.

As much as $1.1 billion spent on anesthesia for gastrointestinal procedures each year may not be medically necessary, the researchers concluded. Insurers often foot the bill for full anesthesia, but not always.

Mr. LaRose, 48, said that he did not want to have full anesthesia in the first place. After his first consultation with the doctor, he said, he called his gastroenterologist?s office and told a staff member of his preference.

But when he showed up for the colonoscopy on June 24, 2010, his doctor, Dr. Kristin Patrick Naso, told him the procedure is normally done with Propofol, which requires an anesthesiologist. By then Mr. LaRose had already spent 24 hours fasting and going through the unpleasant cleansing preparation, he said.

Mr. LaRose said he relented after the doctors assured him that anesthesiology would be covered. ?You?re starving and gaseous and you just want to get the whole thing over with,? Mr. LaRose said.

In an interview, Dr. Naso said his office provided all patients with a notice saying that the anesthesiologist might not be covered by insurance and providing the anesthesiologist?s phone number for more information.

Although Dr. Naso was in network and accepted payment from Mr. LaRose?s insurer as payment in full, the anesthesiologist, Dr. Michael Rus, billed $1,600 for the procedure. He was reimbursed $588 by the plan and, after failing to collect the remainder from Mr. LaRose, sent the balance to bill collectors.

Dr. Rus did not respond to requests for comment.

It was a similar situation when Ms. LaMontagne went for her colonoscopy. She said she told Dr. Michael Krumholz in Manhattan about her husband?s experience and her concerns about a lack of coverage for full anesthesia. She said she was not told about conscious sedation, which is not available at his practice. Instead, Ms. LaMontagne said, she was told that full anesthesia was standard practice. She went ahead with the procedure in February.

Dr. Krumholz accepted $192 from Ms. LaMontagne?s insurance company, Freelancers Insurance Company, which is affiliated with the Freelancers Union. But the insurer rejected the bill from the anesthesiologist, Dr. Joanne Goldman, because she is out of network.

So Dr. Goldman?s charge was sent to Ms. LaMontagne: $2,800. She called Dr. Krumholz?s office to ask about this charge and any others of which she might be unaware. She said she was told there would also be an additional ?facility fee? of $1,800 charged by the endoscopy clinic.

In an interview, Dr. Goldman said she did not do the billing herself and could not address questions about it.

In an e-mail, Dr. Krumholz said that he tells all of his patients about the risks and benefits of colonoscopy, as well as alternatives to the procedure, and of the benefits of and alternatives to anesthesia. He will perform the procedure without anesthesia if the patient so chooses, he said, but his practice does not offer conscious sedation, nor do ?most modern endoscopy facilities in New York.?

Jordan Fowler, chief executive of Frontier Healthcare and business manager of the endoscopy center where Dr. Krumholz practices, said Ms. LaMontagne ?should not lose sleep? over the charges because the anesthesiologists in the group are about to become in-network providers.

Asked whether a $2,800 charge is reasonable for about 30 minutes of anesthesia, he said, ?You bill a high fee to negotiate with an insurance company.?

Sara Horowitz, founder and executive director of the Freelancers Union, said the trend toward using two doctors for a colonoscopy is ?outrageous, when we have another perfectly good kind of anesthesia, twilight sleep, that the GI can do him- or herself.?

But there?s a bigger problem for consumers here, too. Many physicians who are not the primary contact with patients ? like pathologists and radiologists as well as anesthesiologists ? do not participate in health insurance plans. When they provide medical services at hospitals or outpatient centers, their charges may not be covered, or may be only partly covered, leaving even well-insured people with large, unexpected bills.

So, what to do if you need a colonoscopy?

CONSIDER ALTERNATIVES Other recommended colon cancer screening methods include the fecal occult blood test, which involves collecting stool samples at home, and sigmoidoscopy, in which a long, flexible tube with a tiny video camera is used to examine the lower colon. Indeed, a study published in The New England Journal of Medicine last week found that patients who underwent sigmoidoscopy had lower rates of colon cancer and lower cancer death rates.

PLAN AHEAD You know when you?ll be turning 50, so estimate your costs in advance and put money away in a health savings account, so at least you?re not paying taxes on it. (Remember, you may lose the money if you don?t use it.)

ASK QUESTIONS When speaking with your gastroenterologist about the procedure, find out what kind of anesthesia will be used and who is going to administer it. If he or she insists on an anesthesiologist or a nurse anesthetist, you have two options: find a gastroenterologist who administers sedation on his or her own, or make sure the anesthesiologist is covered by your plan.

Kahne ends drought, captures first win at Hendrick

CONCORD, N.C. (AP) ? Kasey Kahne was starting to feel a little guilty.

Sure, he'd finished in the top 10 in five of the last six Sprint Cup races, but he still hadn't picked up that elusive first victory for car owner Rick Hendrick.

"Our team is solid. Our car is solid. Mr. Hendrick gives us everything we need to win races and run up front," Kahne said. "I just knew for myself I needed to step up."

And he did just that.

Kahne pulled away to victory in the Coca-Cola 600 on Sunday night, winning NASCAR's longest race for the third time and gaining his stripes for Hendrick Motorsports the only way that matters ? taking the checkered flag.

"I never really doubted myself," Kahne said. "I was upset at some of the things that may have happened. I made a huge mistake at Phoenix, hit the wall there. But other than that, we were solid, we were fast. It was just a matter of getting past those five weeks and moving on and putting some solid races together."

The self-imposed pressure grew this week before Charlotte Motor Speedway at a party Hendrick threw to celebrate the owner's 200th career win Jimmie Johnson earned at Darlington Raceway two weeks back. Kahne was introduced as part of the current team ? after the 15 drivers who won races for Hendrick took a bow.

Hendrick then challenged him to win the Coca-Cola 600.

Despite the challenge, Hendrick could tell the losing streak was wearing on Kahne and tried to assure him that better times were ahead.

"Well, I could see that it was bothering him," Hendrick said. "A racer doesn't like to wreck a car or have bad luck. You could see it with Kenny, too. They hated to have those problems. When you can see, again, they had speed. I tried to reassure them, 'Look, we're in this for the long haul. You guys are running good. You just have to have some breaks.'"

And it was a popular victory.

Teammate Jeff Gordon rushed up to hug Kahne after the race and told him, "Proud of you."

What a roll for Hendrick Motorsports. The program was stuck on 199 victories since October. Then came Johnson's milestone win at Darlington. The five-time champion followed that with a victory in the All-Star race at Charlotte last week.

Kahne led four Hendrick cars in the top 11. Dale Earnhardt Jr. was sixth and Gordon was right behind in seventh ? only his third top 10 finish of the year. Johnson came in 11th. He was vying for more but fell from contention with a mistake on the final pit stop as he left the stall with his gas can still engaged, dragging his crew member behind.

Johnson was docked with a stop-and-go penalty that ended his chances at winning a third straight week.

"I think we're showing the consistency from all of our teams," Hendrick said. "I can't wait for the second half of the season."

Kahne crossed the finish line nearly 5 seconds ahead of Denny Hamlin. Kyle Busch was third and series points leader Greg Biffle fourth.

It was Kahne's 13th career win and first since last November in Phoenix.

Kahne's a racing gym rat who can't stay away from competition. He drives in NASCAR Truck races when the Sprint Cup series is off ? as he did at Darlington in 2011 and Rockingham this spring ? and raced this weekend in the World of Outlaws dirt track contest across the street from Charlotte Motor Speedway.

Kahne led 96 laps, including the final 42. He doesn't see why the winning can't continue.

"I just know that the cars and the people we have that Mr. Hendrick gives us is everything that we need to win," Kahne said.

Danica Patrick, the first woman to drive in the race since Janet Guthrie in 1976, was five laps down in 30th ? her best finish in three career Sprint Cup races.

Car owner Chip Ganassi flew to Charlotte after celebrating Dario Franchitti's win at the Indianapolis 500 earlier Sunday. Ganassi, part of Earnhardt Ganassi Racing, had hoped to double up with drivers Jamie McMurray and Juan Pablo Montoya. But 250 laps in, McMurray was a lap down and Montoya two behind after needing an extra pit stop to tighten a loose wheel.

"The minute I walked into the garage, people were high-fiving me," Ganassi said. "Right now, we've got to get our cars up the grid."

It didn't happen as Montoya finished two laps down in 20th and McMurray right behind in 21st.

For much of this race, it looked as if Biffle wouldn't be caught. He led 204 laps to dominate early and was clearly best as the race began in the hot, bright sunshine. Once the night cooled off the track, Biffle was no match for Kahne.

"Kasey's car was just better at night," Biffle said.

An early crash took Patrick out of contention in the season-opening Daytona 500 and she finished 38th. Patrick returned to Sprint Cup two weeks ago at treacherous Darlington and lasted throughout at the track considered "Too Tough to Tame" and crossed the line in 31st.

Patrick's goals this week were simply to be running at the end ? and that she was. Starting 40th after a poor qualifying effort, Patrick quickly fell top laps down. But she held on throughout the long, long night.

Patrick also kept her humor. When she was cautioned by her team to keep hydrating, Patrick cracked, "Copy that. Every time you don't get an answer to a question, that's what I'm doing."

Patrick's next Sprint Cup race will be at Bristol on Aug. 25. She promised to be more aggressive upon her return.

"Now that I'm getting more comfortable in certain situations, it's time to start testing those waters and freeing the car up a little bit and seeing what we can get out of it," Patrick said.

Earnhardt had hoped to avenge last year's heartbreaking loss when he ran out of fuel 700 feet from the finish line while leading. Earnhardt came as close to second and was drag-racing Hamlin for the lead on the final restart before as the large crowd at Charlotte Motor Speedway howled. Earnhardt, too, couldn't keep up with his teammate and his winless drought grew to 141 races.

NASCAR's king, career victory leader Richard Petty, had both his entries starting 1-2. But polesitter Aric Almirola quickly fell back and finished 16th. Marcos Ambrose, who started second, broke a wheel hub and ended up 32nd.

The race was the quickest ever for the 600 at 3 hours, 51 minutes, 14 seconds, nearly 5 minutes faster than the mark set in 1995.

Let's End The Confusion About Real Estate Photography Copyright

For as long as there has been professional real estate photography there?s been total confusion about who owns the copyright to real estate photography. agbeat.com has a good example of the crazy TOS of most MLSs. There are only very a few exceptions. Here?s the situation:

  1. Real estate photographers believe and behave like they own the copyright (which I believe they do if this was settled in a court case).
  2. Listing agents for the most part don?t care about, pay attention to or understand copyright and photo licensing. They just do whatever?s necessary to get their listing online ASAP.
  3. MLSs are concerned about the potential legal risk of having copyrighted photos that they don?t own the copyright to in their listing databases that they syndicate to large number of real estate sites, so they say in their terms of service that the act of uploading photos transfers the copyright to the MLS or specify that no copyrighted photos can be uploaded to their MLS.

This can?t be rocket science! I cannot see why it isn?t possible to have a TOS agreement that works for all parties here. It would say the photographer or whoever created the photos owns the copyright (standard intelectual property law since they created the photos) and the creator of the photos grants a limited use license to the listing agent and the MLS that allows both the agent and the MLS to do whatever they need to do to take care of business. The listing agent would have the photographer sign this page and adds it to the 30 or so other pages of the listing agreement that they file with their broker and the MLS when they take the listing.?

I think this is a good time to get this?craziness?fixed because the recent flap about listing syndication is raising the awareness of agents of who owns the listing data. They are starting to think more about having control of their listings.

I?m in the process of attempting to contact some legal people involved in creating MLS rules to see what they think about resolving this issue. Seems like if it?s solved in one large MLS perhaps others would follow suit. If anyone knows of any MLS that is already setup this way I would love to know about it. I know their is at least one in the US but I can?t remember where it is.

One Story of Infidelity

  • Any similarity to you or someone you know is just that a similarity. So many people have similar stories.

About two years ago I began working with a couple that began marriage counseling, believing that they would get a divorce. At the point they came to me, their relationship seemed to be based upon a bond of hostility. They consistently argued angrily as their main form of communication. Both said that they loved each other very much after 19 year of marriage; which let me know that there was hope for this couple.

What led them to reach out for my assistance was that the husband (we will call him Peter), confessed to his wife, (we will call her Robin), that he had been having an affair for over 16 months. At first Peter was only aware of feeling shame and Robin was only aware of feeling hurt and anger. Robin, as you can imagine, felt a gamut of emotions, rage, anger, hurt, shame, and confusion to name just a few. Peter, as we became more involved in the work, also began to feel a whirlwind of emotions, anger, confusion, resentment, hurt and shame.

As time passed and we worked on their communication, forgiveness and reconnecting, Peter began to feel quite resentful and impatient that Robin seemed unable to forgive him faster. Both Robin and Peter had the tendency to blame the other for the affair as well as anything that they did not like in the relationship. It took much hard work for them to reach the place where they could truly hear each other without wanting to prove that their version of the truth was correct for all. Once this occurred the couple began to move towards re-connecting and the work of regaining trust within their relationship.

As they moved forward, Robin and Peter began to laugh with each other in my presence as well as report back to me that they were having fun together again and having ?hot? sex.

They both shared in a session that they now believed they could and would reach their goal of rebuilding their relationship. It took several more months of intensive marriage counseling for Peter and Robin to reach the place they are now. Robin no longer blames Peter for ?the affair?. She understands her part in the weakening of the marriage and is willing to forgive Peter. She has also regained a high level of trust in him and for their marriage?s continued growth. Peter no longer feels shame and understands his motivations, actions and the consequences of them. They have come a long way from the couple that came to me thinking that they would get a divorce.

Farmington High parts ways with state champion boys soccer coach Felix Chacon

Farmington High School is making a change at the top of its defending state champion boys soccer program.

Felix Chacon, who coached the Scorpions to the 4A state title in 2011 and was a member of the coaching staff during the team's 2009 state championship run, was removed from the position on Friday.

"Farmington High has made a decision to make a change with our boys soccer team," said Farmington High athletic director Don Lorett. "We have great kids and will move forward and continue to strive for success."

That was the only explanation Chacon said he received via email from the school on Friday.

"Apparently the only direction from the top is downhill. In order to keep coaching at FHS, one must not aspire to achieve new heights or be successful," Chacon said. "My commitment, credentials and experience with the FHS boys soccer team speaks louder than any snake hissing in the grass."

Lorett declined to comment on the reasons for Chacon's dismissal.

"It is discriminatory in nature and propagated by personal and political vendettas of an unloyal and insecure authority," Chacon said.

Chacon, who also earned two different coach of the year honors during his tenure with the Scorps, will continue to teach for Farmington Municipal Schools, and said he will turn his focus on coaching his kids.

"I am going to take a break and dedicate my time to my young daughters' soccer development as well as youth development in the community via

club soccer, and focus on my teaching responsibilities for FMS and the University of New Mexico."

The Scorpions boys soccer program has been highly successful, sending two players in three years to the UNM Lobos program along with its state championship success.

Charles Klepac, a Scorpion senior captain on the 2011 team and Lobo commit, was taken back by the news on Friday.

"It certinaly surprised me. He was a good coach and I honestly don't see why he lost his job," Klepac said. "He knew the game and taught all of us a lot of things I believe."

Ryan Reeves, another a senior captain on the 2011 team, said the lessons learned from Chacon went beyond soccer.

"He lost the job? And after a state championship? I felt like he pushed us to new boundaries that we didn't know we could go. He not only helped us grow on the field but also as individuals," Reeves said. "He was a great coach."

PC Software World ? Gaming Computer systems ? The Rise with the ...

The intention of this tutorial is always to give you a primary idea of what you will require to buy to generate gaming achievable on a notebook. Essentially the most essential regions I?ll address are, operating interesting, graphics cards, and CPU performance.

The dilemma that many avid gamers will now consult is, ?Are you nuts??, why pay a top quality for a cheap gaming laptop computer once you can get a deluxe desktop that is only better for the very same money? The actual fact is usually that even if laptops are a great deal less resistant, pretty much not upgradeable, plus much more high priced lots of men and women like them and carrying all around a desktop is solely not a possibility more often than not.

It is best to anticipate to pay for about two times as much for your notebook rig as to get a desktop. There are numerous low-priced laptop options however you really need to tread really cautiously.

Something to remember in all of this nevertheless is the fact that your notebook is not going to be upgradable except you?ve some considerable competencies. To the most component online video cards and CPU units are soldered into laptops. No popping a whole new video card in there once the cost drops just a little. You may need to do some severe preparing forward for getting what we want for that next couple of several years.

Why two several years? The fundamental lifetime for just a notebook is 2-3 ages, sucks but that?s the way it is. The more modern games that come out shall be have requirements that are simply just not available today or not inside of a sensible expense assortment. Moore?s legislation in this case is effective towards you.

Hardware Things to consider

You should be trying to find close to the prime conclude for each in the next, CPU, RAM, and graphics cards.

Graphics Cards

Graphics cards are fairly basically probably the most significant component of any gaming pc. If you don?t use a great card you don?t have video game. You?ll need to accomplish somewhat investigation to uncover what the best is out there for the time being while it improvements quickly. Require a look specially for Nvidia and AMD as they are the marketplace leaders.

Central Processing Device

There are actually two steps which have been vital when paying for a CPU, clock velocity along with the variety of cores. Recent state of the art bare minimum is about 2.0 GHz. Most game titles in the intervening time really don?t profit from an elevated amount of cores. I count on that that will improve as time goes on. It is a place nevertheless in which you can get a cost gain in the intervening time. Quad core CPUs value about $100 a lot more than double core and for any gaming computer system in the intervening time you most likely isn?t going to need to have the additional cores.

Memory

This is the a person space in which you have the option of upgrading later. This getting reported I propose that you simply obtain a 4GB memory adhere in your notebook. This can let you update afterwards to 8GB and strengthen the render occasions for graphics versus two 2GB memory sticks. Presently 8GB of memory is a big level of memory, it really is uncertain that you will have need for much more than this from the upcoming few of several years.

Manufacturers

The ideal overall brands for a cheap gaming laptop are Asus, Alienware, and MSI. All of them have configurations that happen to be designed for gaming as well as a lot of experience inside the area. You can locate Alienware and Asus on amazon normally for just a pretty good expense. MSI is usually a small more durable to trace down.

Conclusion

For anyone who is going to place out for just a gaming laptop computer hope to shell out twice as much for any personal computer that could last 50 percent as prolonged. If that does not cause you to blinks then you are in your technique to possessing a good portable gaming option. In case you have need to have of it for other programs like operate what?s more, it may perhaps be very easy to justify the price. Ensure even though that though you are attempting to put with each other an affordable gaming laptop you don?t shirk from having to pay for a few with the substantial conclusion parts. Game titles at this time are generating utilization of them plus the long term will only be a lot more intensive not a lot less.

If you find yourself in need of a cheap gaming laptop these are available on Amazon.com and I highly recommend them.

How Twitter Does MySQL - Get Their Fork

Twitter is a big proponent of knowledge sharing and open source software.? It's also well known that Twitter moved away from Casandra, and turned back towards relational databases, like MySQL.? But with the number of users and large amounts of data that Twitter handles, they have had to make some impressive additions and changes in creating their own "flavor" of MySQL database, based on MySQL 5.5.? Now you can see how they were able to take MySQL so far as they have announced that everyone can get a taste of what Twitter's been cooking, by releasing their MySQL fork on GitHub.? Here are some of the changes they've made:
  • Add additional status variables, particularly from the internals of InnoDB. This allows us to monitor our systems more effectively and understand their behavior better when handling production workloads.
  • Optimize memory allocation on large NUMA systems: Allocate InnoDB's buffer pool fully on startup, fail fast if memory is not available, ensure performance over time even when server is under memory pressure.
  • Reduce unnecessary work through improved server-side statement timeout support. This allows the server to proactively cancel queries that run longer than a millisecond-granularity timeout.
  • Export and restore InnoDB buffer pool in using a safe and lightweight method. This enables us to build tools to support rolling restarts of our services with minimal pain.
  • Optimize MySQL for SSD-based machines, including page-flushing behavior and reduction in writes to disk to improve lifespan.
-- Twitter Engineering

Of course, since this software is open source, there are no guarantees of bug fixes or maintenance issues, and it is not intended for use outside of Twitter (it's really designed to let people take a look at what Twitter has done to MySQL).? However, having such a powerful persistent storage technology at your fingertips is a rare opportunity, so be sure to check it out.

Why it's important to plan your final goodbye - Bayshore Home Health

Saying goodbye is the hardest thing to do, especially to a loved one. Usually, it?s not just ?Goodbye,? it?s ?See you when you get back,? or ?See you when you return from college.?

On the other hand, saying goodbye forever is never easy, whether we have warning that our loved one is going to die or their death is sudden. Is there a way to make this heartrending experience better?

I believe there is, and it starts with a plan ? a plan for dying. Other challenges we face in life have instructions, directions and guidelines, but when it comes to dying we seem to have to wing it. ?I think he may have wanted it that way,? ?She never told me her wishes?? I?m sure everyone has heard words like that following a person?s death, but this type of uneasiness and uncertainty can change with a simple plan.

Three years ago next month, my father died. As a family, we have peace of mind knowing we honoured his wishes. My mother and I were at his side in the comfort of his home as he took his last breath and we said goodbye. It doesn?t matter how many years go by, the tears will always be there. But I know in my heart it was how he wanted to go. My mother-in-law, 17 years ago, had the same wish to die in her home with her family by her side. These are the wishes and plans of a good death.

A saying we often hear is, ?He had a good life.? But I think we should ensure that people also say, ?He had a good death.?

Even within health care there is uneasiness about dying. We?re good at saving lives, but not so good at ending them. With this week?s blog post, I want to illustrate some things that could make the death of a loved one a little easier, if that?s at all possible.

The World Health Organization suggests an approach that?s meant to improve the quality of life of patients and their families who are facing the problems associated with life-threatening illness. The plan includes prevention and relief of suffering by means of early identification, and impeccable assessment and treatment of pain and other problems whether physical, psychosocial or spiritual.

Death and dying is not the conversation most would have at a cocktail party or bridge night, but it certainly should be part of your family?s dinner table conversation. Think about it. Would you rather let your loved ones know your wishes or have them take a guess in the event of a tragic happening? There?s an amazingly poignant song by The Band Perry called If I Die Young. I recommend you all have a listen. This girl has got it right and she?s only in her 20s. http://youtu.be/JKvIo1EDt0s

It?s natural to feel trepidation about death and fear the disconcerting dying process. I recommend three things that can put your mind at ease. It?s not time sensitive; you can start at any age.

1.?Initiate the death and dying conversation. It can be as causal or formal as you feel comfortable with. The key is to start it: ?My wish if I were to die would be?? I?ve had the conversation with my husband and teenage children because it?s important to me that they?re not upset over the death planning, but instead have the occasion to remember the good times and celebrate the good life with a good death.
2.?Express your wishes to your family, friends and health-care providers. Write it down. It?s important for everyone to know your wishes, not just one person. And share your wishes in advance so there?s no remorse and angst. Unfortunately, during dying and death there are always family dynamics due to the stress and fear of the unknown.
3.?Prepare for death, physically, emotionally and spiritually:
a.?Learn what resources are available and who is responsible for what.
b.?Arrange for care ? this you can?t do on your own.
c.?Plan for support. It takes a team, family, government programs and community supports.
d.?Create a care plan for disease, diagnosis, prognosis and treatment (i.e. pain management).
e.?Transition of dying phase ? determine location, bringing hospital to home, hospice centre.
f.?Funeral plans: Pre-planning is best.
g.?Aftercare, closure, legacy? these are hard to do when your loved one is gone. Do it in advance and put some thought to it.
h.?Celebration of life is one of the most important things to plan. How do you want yourself or your loved one to be remembered?
i.?Grieving and mourning: Saying goodbye! This is natural and it?s OK. I grieved and mourned; now I remember every time I light a candle.

Health-care professionals do their best to support individuals and families to make informed decisions that are consistent with the beliefs, values and preferences of your loved one. But don?t leave it completely up to them. A good death is all about you, your wishes and your family?s comfort zone. Only you can make this precious decision, so plan ahead. The absence of an end-of-life care plan may mean more pain and suffering for everyone.

There?s a formal process called Advanced Care Planning. For information, or to download the book, A Guide to Advanced Care Planning, visit: www.seniors.gov.on.ca/en/advancedcare/index.php. It?s not just a document, it?s a plan that ensures a quality death and it?s a way to ensure that you receive the care that?s most important to you at the end of your life or the life of your loved one.

I wrote my father?s obituary and I carry it in my wallet. I watch every spring as my garden comes to life? and I remember.

Social Media For Women (And Men) Of A Certain Age | The Social ...

image of BoomBox.com boomer images

?

Statistics show that social media usage among women, and men, of a certain age (read Boomers and older) is climbing rapidly. According to the Pew Internet study of Older Adults and Social Media, Half (47%) of internet users ages 50-64 and one in four (26%) users age 65 and older now use social networking sites. Yet there is a disconnect between the rising usage of social media networks and other tools for personal use and use of those same tools for business.

Baby Boomers, strong in number and loud of voice, are in decision-making positions. We are doing much of the hiring, firing and evaluating in businesses and organizations. And somehow, many of us are not making the leap to business usage of social media?yet. In spite of mounting evidence of the efficacy of using social media tools, including social networks, video sharing, blogging and texting, to:

  • Increase qualified leads for goods and services
  • Improve search engine rankings
  • Provide customer service
  • Educate
  • Innovate
  • Organize
  • Build relationships with customers, prospects and media
  • Increase traffic and exposure
  • Develop loyal fans

The term Baby Boomer typically describes men and women born between 1943 and 1962.? Some of us, laughingly prefer to refer to ourselves as being ?of a certain age? and we see ourselves as still youthful (still), vibrant and powerful?no matter how we are perceived by everyone else. We are the generation that came up with the Vietnam War, with television, what we now call ?snail mail?, the Civil Rights movement, the liberated youth culture, radio and advertising that pushed commercial messages at us in every medium.

The race to be online, to share information, to connect across all boundaries feels alarming to many of us. The fast pace of the changes that take place online can overwhelm. Many of us have reached a certain position in our work and have become accustomed to doing things ?the right way?, meaning doing things the way we were trained many years before. We have become skeptical about anything related to marketing or advertising and place great faith in the printed word or the six o?clock news. We are intimidated by the new technology and secretly believe that all this noise about digital this and online that and social whatever is just that: noise. Something the younger kids care about. A fad.

This mindset is not uncommon and takes patience to work with. Just last night a friend and I were commiserating about his frustration with colleagues of our generation, and how they were missing the importance of using social media tools to communicate with their customers during a particularly grueling customer service snafu. He felt that his colleagues were unwilling to move forward and were unwittingly making things harder for themselves.

I am often asked how I, at my age, have become so involved with social media and social networking. How is it I have learned all of this? And why?

I explain to people of my generation that the social networking done online closely resembles offline business networking. That sparks interest. It?s all the same stuff, I tell them. Human beings have not changed so much over thousands of years, I explain. Our instincts and motivations remain the same. We search for information, validation, connection, assistance and entertainment. We share what matters to us and what we find important. And slowly we learn how to use these new tools, how these social media benefit our businesses and organizations.

It is changing. Our world is changing and we are changing with it. Some of us reluctantly, some with great excitement and some of us kicking and screaming. The internet offers us a reflection of our humanity: the good, the bad, and the ugly. We can embrace these powerful tools and use them in both personal and business lives. And if it takes us a little longer to figure it out? No matter. What we bring to the table in terms of life experience and earned wisdom complements the rabid intelligence and high energy of younger generations.

Predictions are for increased us of social media in business. Some expect social media will replace traditional media in the next three to five years. Those of us of a certain age will continue to experiment with social media and social networking in our private lives and, because we want to stay relevant, we will pay attention to how the use of social in business is evolving. We?ll get there.

Do you need help understanding how social media tools can benefit your business or organization? We can help. Call us at 419.740.1262 or shoot us an email at info@allenmireles.com. We love this stuff and we can help integrate the new social tools into your existing marketing and public relations programs.

And I?m your age, so I can help you feel comfortable about taking this on. Follow me on Twitter and you?ll see what I mean.
